1. Overview

These Terms of Service ("Terms") govern your use of bin rental services provided by New Earth Waste Services ("we," "us," or "our") in Calgary and surrounding areas. By engaging our services, you agree to these Terms in their entirety.

2. Services Provided

New Earth Waste Services provides waste bin rental services for residential, commercial, and construction purposes. Our services include:

  • Delivery of waste bins to customer-specified locations
  • Temporary rental of waste bins for agreed-upon periods
  • Pickup of waste bins at the end of rental periods
  • Disposal of collected waste in accordance with local regulations

3. Booking and Payment

3.1 Booking Process

Customers may book our services through our website, by phone, or by email. All bookings are subject to bin availability and our service area restrictions.

3.2 Payment Terms

Payment is due at the time of booking unless otherwise agreed upon in writing. We accept credit cards, debit cards, and electronic transfers. For corporate accounts, invoicing terms may be arranged separately.

3.3 Pricing

Prices quoted include standard bin rental duration, delivery, pickup, and disposal of waste up to the specified weight limit. Additional fees may apply for:

  • Excess weight beyond included tonnage
  • Extended rental periods beyond the standard duration
  • Special materials requiring separate handling
  • Difficult access locations requiring additional equipment or labor
  • Cancellations or rescheduling with less than 24 hours' notice

3.4 Refunds and Cancellations

Cancellations made more than 24 hours before scheduled delivery will receive a full refund. Cancellations within 24 hours of scheduled delivery may be subject to a cancellation fee equal to 25% of the rental charge. No refunds will be issued after bin delivery has occurred.

4. Bin Delivery and Placement

4.1 Delivery Location

Customers are responsible for:

  • Providing accurate delivery address and placement instructions
  • Ensuring adequate space for bin placement and truck access
  • Obtaining any necessary permits or permissions for bin placement on public property
  • Ensuring the placement location can support the weight of the bin and its contents

4.2 Property Protection

While we take reasonable care during delivery and pickup, New Earth Waste Services is not responsible for damage to driveways, lawns, landscaping, or other property resulting from normal bin placement and removal operations when carried out according to customer instructions.

4.3 Bin Relocation

Once placed, bins should not be moved by the customer or their agents. If relocation is required, please contact us to arrange for proper moving of the bin. Additional fees may apply for bin relocation services.

5. Use of Rental Bins

5.1 Acceptable Materials

Our bins may be used for disposal of general waste, renovation debris, yard waste, and other non-hazardous materials. Specific bin types may have additional restrictions.

5.2 Prohibited Materials

The following materials are strictly prohibited from being placed in our bins:

  • Hazardous waste (chemicals, solvents, oils, paints, pesticides)
  • Toxic materials or contaminated soil
  • Asbestos or asbestos-containing materials
  • Biomedical or infectious waste
  • Compressed gas containers or tanks
  • Batteries, electronics, or appliances containing refrigerants
  • Tires, automotive parts, or fluids
  • Radioactive, explosive, or highly flammable materials
  • Any materials prohibited by local waste disposal regulations

Customers who place prohibited materials in bins will be held responsible for any resulting penalties, disposal fees, or damages.

5.3 Loading Restrictions

Bins must be loaded according to the following guidelines:

  • Do not exceed the maximum fill level (typically level with the top of the bin)
  • Do not overload the bin beyond the specified weight limit
  • Distribute weight evenly throughout the bin
  • Do not place items on or around the exterior of the bin

Additional charges will apply for overloaded bins, and we may refuse to collect bins that are unsafely loaded or contain prohibited materials.

6. Rental Duration and Extensions

6.1 Standard Rental Period

Unless otherwise specified, the standard rental period is 7 days. This period begins on the day of delivery.

6.2 Extensions

If you require the bin for a longer period, please contact us before the scheduled pickup date. Extension fees apply for each additional day beyond the standard rental period, subject to availability.

6.3 Early Pickup

If you finish with the bin earlier than anticipated, please contact us to arrange an early pickup. No refunds are provided for unused rental days unless agreed upon in advance.

7. Customer Responsibilities

Throughout the rental period, customers are responsible for:

  • Ensuring the bin remains accessible for pickup
  • Preventing unauthorized dumping in the rented bin
  • Securing any required permits or homeowner association approvals
  • Compliance with all municipal bylaws and regulations
  • Ensuring that the bin and its contents are protected from theft, vandalism, or other damage

8. Liability and Insurance

8.1 Property Access

By ordering our services, you grant us permission to enter the property at the specified address for bin delivery and pickup.

8.2 Limitation of Liability

New Earth Waste Services is not liable for:

  • Damage to property resulting from the weight of properly placed bins
  • Damage caused by improper use of bins by customers or third parties
  • Indirect, consequential, or incidental damages
  • Delays in service due to weather, traffic, or other circumstances beyond our control

Our total liability shall not exceed the amount paid for the rental service.

8.3 Insurance

New Earth Waste Services maintains appropriate insurance coverage for our operations. However, this insurance does not cover customer property or customer activities related to bin use.

9. Privacy Policy

New Earth Waste Services collects and processes personal information in accordance with our Privacy Policy, which is available on our website. By using our services, you consent to our collection and use of your information as described in that policy.

10. Amendments to Terms

New Earth Waste Services reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of Alberta, Canada. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Alberta.
